FHSAA suspends Nick O'Leary for obscene gesture; Dwyer says it will forfeit rather than play without him

Wednesday, September 08, 2010
by Matt Porter

Dwyer High's loss to Cleveland-Glenville on Labor Day in a season-opening game televised by ESPN received national attention because of two disputed calls in the final moments that apparently cost the Panthers a winning touchdown.

Dwyer star Nick O'Leary, frustrated by the calls and taunting by Glenville players, responded with an obscene gesture that was caught on camera and replayed continually on TV and the Internet.

The Florida High School Athletic Association took action against O'Leary on Wednesday, suspending him for two games, Dwyer coach Jack Daniels said.

Daniels, angered by the FHSAA ruling, said late Wednesday that the Panthers would not play without O'Leary and would instead forfeit the games.

"We think it's a bunch of crap," said Daniels. "There are no repercussions for the adults who made the calls on the field, but there is for an 18-year-old kid who reacted in the heat of the moment.

"You have a kid who has busted his butt since August. He played 140 snaps against Glenville, on both sides, punting and returning kicks. He was frustrated."

O'Leary, a senior, is among the top prospects in the country at tight end and is the grandson of golf legend Jack Nicklaus, who attended the game at Ohio State in Columbus.

The Panthers are scheduled to host Palm Beach Gardens on Saturday and Pahokee on Sept. 17.

The team disciplined O'Leary for the gesture but did not suspend him from any games.

"We handled it internally. Nick knew he was wrong," Daniels said.

After the FHSAA called Dwyer and learned that O'Leary had not been suspended by the school, the organization imposed its own penalty, Daniels said.

FHSAA spokesman Seth Polansky said via e-mail late Wednesday that he could not comment on the situation until Thursday morning.

Palm Beach Gardens coach Chris Davis said his team would like to play against Dwyer on Saturday, but he feels for O'Leary and his teammates.

"I can't comprehend the emotions that are going on in that locker room," said Davis. "I can understand that they would take that stance in support of Nick, against what happened in Ohio."

Dwyer and Cleveland-Glenville, national powers in high school football, were invited to Columbus for the Kirk Herbstreit National Kickoff Classic.

Herbstreit, an ESPN college football commentator, said earlier Wednesday that he was distraught over the way things turned out.

"It made me sick to my stomach," he said on The Joe Rose Show on 560-WQAM.

"I was with a buddy of mine. He played high school football with me, and I said, 'Imagine if we flew down to Florida to play one of their better teams and we drove the last drive and scored the winning touchdown and a Florida referee looked us in the eye and said, 'Nope.'

"And we scored another winning touchdown and a Florida referee said, 'Nope.' And we scored a third winning touchdown and a Florida referee said 'Nope.' "

"I mean, I'd feel like O'Leary, too. I mean, I'd be upset, too."

Palm Beach Gardens' Davis agreed.

"I felt like Kirk Herbstreit," he said. "They were representing Florida, and we were all behind them. Every school in the state was that day, and I think we all got robbed."

What a bunch of crybabies. The whole team suffers and will forfeit the game??
Shows everyone you who runs that team, sure isn't the coach.
Take your suspension like a man.
This coach is spineless and as far as Nick O goes "learn some sportsmanship"!!!!!
There will be plenty of bad calls in life, suck it up.
Now there is not only a bad call but bad bad publicity for yourself, family, school,Palm Beach County,The State of Florida.
Oh your Jacks grandson, you'll get a pass.

Boca parent commented on September 8, 2010 at 11:51 p.m.: report abuse

What does or did the FHSAA have to say about the 2 bad calls that determined the outcome of this football game ? Shame if they are silent about this.
They should be speaking up regarding the injustice done to this team by the refs.
I am proud how these young men and their coaches represented Palm Beach County and the entire state of Florida in the world of high school football. Thanks to instant replay, everyone can easily see the bad calls. The players for the most part all reacted with alot of class. Well done gentlemen ! You were the winners . The game was outright stolen from you. Let's hear it FHSAA.

O`Leary, poor little boy needs to grow up. He should keep it to himself and move on. I wonder how many mistakes he has made in his little world. Officials do make bad calls at times. Accept it. The FHSAA did the correct thing and the coach should be reprimanded too. His bad example is not good for the kids he is trying to set an example for. Suck it up coach and move on. Its only a game.

life isn't "fair". little spoiled rich kid loses his cool and his coach isn't man enough to take the heat. Part of the problem is that todays coaches are also spineless. Go ahead and punish the entire team for the mistake of one. Both should man up, and get on with life. because life isn't fair....

JMG commented on September 9, 2010 at 12:24 a.m.: report abuse

I normally just ignore bitter and ignorant comments on subjects like this, but your lack of knowledge or understanding for the subject at hand is humorous. The team is standing behind Nick because what happened in Ohio was horrendous no matter what team you were rooting for. Let me ask you something: would you want to win a nationally televised game where everyone blatantly saw that Dwyer scored multiple times? They know they lost - heck, the world knows they lost. It's an embarrassment to Ohio. You clearly have a lack of experience in what a team actually is or how one is supposed to operate. The reason this team wins games is because they stand together: the coaches, the players, the parents. Jack Daniels is an incredible coach from no matter if you look at this past season or the past ten. He rarely, if ever, allows things like this happen and as history proves, he's a fair guy with a no B.S. policy. If this is the decision that was made, then you bet your "billybob" butt that there was some thought that went into that and it wasn't only Jack Daniels making the executive decision. As for Mr. Nick O'Leary, he's one of the greatest high school athletes in the country. He's played his ace off in every game since day one. You mean to tell me that you wouldn't have reacted after that many admittedly bad calls? You ask any reputable analyst, sports fan, or athlete if the situation was right and the answer will be no. I'd hardly call it "bad publicity" for anyone, but the officials. Yes, Nick lost his cool and it happened to be on ESPN, but put yourself in his shoes as a high school athlete working as hard as he does or any kid does to have lost like that. Nick's relatives have nothing to do with the matter, so I don't see how that is relevant to your argument at all - his grandfather didn't make him a ball player...kid did that himself and could've easily done it without the reputation. That's pure talent and you can't argue that. Sorry boutcha.

Big ups to Dwyer! Do your thing and stick with it! I beleieve they sticking up for what's right! As a Glades central raider fan, I commend the coach for being down for his team even though they got cheated on heavily! Then for the FSHAA to make such suspension is out of control! Were they palying in Florida or Ohio? DWYER, dont worry bout people saying o Nick is unprofessional and needs to grow up cuz I'm saying do wat you gotta do baby! GO Panthers!

Proud Panther commented on September 9, 2010 at 12:53 a.m.: report abuse

I don't think Nick's grandfather's golf stats got him his football stats. Clearly, being Jack's grandson didn't earn him a pass since he was suspended for two games. Nick is lucky to belong to a true team that stands behind him; I'd like to know how many other players were suspended two games by the FHSAA for making such a gesture after a game like that. Thank you, Florida, for standing behind your own team that played in a national scandal of a game.

Krusader sports fan commented on September 9, 2010 at 1:01 a.m.: report abuse

It amazes me how ignorant many of these posters are. Nick O'Leary played with more heart on one Saturday than many of these people have displayed in their entire lifetimes. O'Leary played tight end, defensive end, punter, punt returner, tailback, and probably equipment manager against one of the country's best teams. I'm proud the Dwyer kids left the field without a punch being thrown. O'Leary is a man's man and credit to football regardless of who his relatives are.
The FSHAA is clearly overstepping it's boundaries with this ruling. This was a game played in Ohio for goodness sake. Now everyone thinks they are Roger Goodell. This is simply ridiculous.

John Q Citizen commented on September 9, 2010 at 1:03 a.m.: report abuse

The FHSAA should be ashamed of itself for suspending Nick. His reaction was restrained and understandable. The refs stole the game not once, twice, but three times from these hardworking kids. I applaud Coach Daniels for supporting Nick and the team. May the FHSAA come to its senses and undo the suspension!!!!

billybob commented on September 9, 2010 at 1:07 a.m.: report abuse

Not arguing the kids got talent. HIS ATTITUDE SUCKS.
So the ref's Gave the game to the other team. Walk tall be a man and know your team really won the game. Don't act like a fool. The other team know's they really lost.
The right thing now would be for him to tell his coach thanks for standing with me but we will not forfeit. Let the other guys play the game.
Alot of Nick O's will come and Go but the Game and all it's disciplines will remain.
Mr Nick O??? He might be one of the greatest athletes in the country but his character is not worth a penny. Learn from this, Remember Its just a game.
JMG, last time I checked.... there was no "I" in TEAM.
And the kid did not make himself great by himself alone..... he had alot of help along the way.
Now he is paying all the people back who previously helped him by throwing this little temper tantrum.
Nick and JMG... Learn something from this.
There is more than just a game at stake here.
And JMG, JD is the head coach, you can bet your JMG BUTT that he is the one who made the decision.
You state that I clearly have a lack of experience in what a team actually is or how one is supposed to operate.
JMG, I played Pro Ball for many years and yes I completely understand how a team operates.
Nick chose to show his ace, He must face the consequences, not punish the entire team because of his tirade.
JMG sounds like you need to grow up, You still think this is about football????

Does the FHSAA have the same jurisdiction in this matter since the game was not played in Florida, but in Ohio? Like there wasn't already enough drama going on, the FHSAA had to add insult to injury. Nick and the whole Dwyer team showed amazing restraint and grace in light of the injustice occurred. If this had been a game of adult men, there probably would have been physical fighting! Kuddos to Coach Daniels for supporting Nick and the team. I hope the FHSAA does the right thing and overturns the suspension.

Nick is not a grown man...he's a kid. The fact of the matter is, you've got all of this "pro experience" under your belt, expecting other people to act their age and you still feel the need to cut down an 18-year old boy. How do you know he didn't go to Jack Daniels and say that he didn't want the team to forfeit and that they should play? You don't. Were you there? No. Who are you (or anyone else) to judge his character based off of ONE poor decision after a tough loss? Do you know him or have you ever even spent time with him? You're telling me it's just a game, when you yourself were the one who decided to open your mouth about who he is and where he comes from. If it's just a game to you, why would you bring all of those external details into it? And to your "clincher" of a statement below...

"JMG sounds like you need to grow up, You still think this is about football????"

...I won't even dignify that with a response.

FRED commented on September 9, 2010 at 1:37 a.m.: report abuse

I have been going to Dwyer games for 15 years and have been telling people for years the head coach has no control over these kids because they seem to have more flags thrown every game than their oponents do 3 to 1. If any coach penilizes the whole team the way this sounds for the actions of one bad mistake by 1 player than this proves he does not really control the team, they control him. Adults emotions sould be an example not an other mistake. Re-read billybob again he knows what he is talking about. I put 3 kids through Dwyer and have been proud of it till i read this artical.

pantherrealwinner commented on September 9, 2010 at 1:41 a.m.: report abuse

Hey BillyBob, sounds like if you were put in Nick's shoes, you would have reacted with your fists and definitely your mouth! Don't think you would have had as much restraint as Nick did to give the finger only once. Why are you pursecuting Nick for the decision to forfeit, it's Coach Daniels' decision, not Nick's. I'm sure he wouldn't want to hold the team back, but a good Coach, and Jack Daniels is a good Coach, stands up for his players and for what is right. He's right when he said that "There are no repercussions for the adults who made the calls on the field, but there is for an 18-year-old kid who reacted in the heat of the moment." What is wrong with this world?

I had a conversation with Gary Pigott (gpigott@fhsaa.org), Senior Director of Athletics at FHSAA, on Tuesday, and HE told me CLEAR AS DAY.

I asked if there was anything FHSAA could do, and he said there was nothing FHSAA could do about anything up there, as it was not an FHSAA game. He went on to detail that it was a contract between the teams, and ESPN, and the Herbstreit group, that Ohio Athletics was handling the officials and game, etc...

I'd venture to say no...

Dwyer folks:

Matt Porter, the journalist doing these articles, knows how to reach me. If you file an injunction, I will go to the courtroom and tell the Judge what Gary told me. Still have the call records on my cell phone to show. Matt, if legitimate folks from Dwyer want to reach me, consider this permission to give someone on staff my email address on this posting.

Rick L commented on September 9, 2010 at 2:51 a.m.: report abuse

There is very little doubt that Dwyer was robbed of a victory in a very hard fought game. However, the subject incident occurred after the game was finished, had no impact on the outcome, and while "unfortunate, unsportsmanlike, and not in good taste" hardly seems like it should rise to the level of punitive action by the FHSAA beyond the action taken by Dwyer coach Jack Daniels - internally.

It's unfortunate for his team that he says that HE intends to forfeit the two upcoming games while Dwyer "star" Nick O'Leary sits out his suspension and hopefully cooler administrative heads will prevail to reverse that intent. Although there is something to be said in favor of Team solidarity, Mr. O'Leary is just one member of the team. Life isn't "fair", accept the punishment, learn from it, and move on.

The time to fight this is "later" between the School and the FHSAA. If the upcoming games, Dwyer Vs Palm Beach Gardens on Saturday and Pahokee on Sept. 17 are forfeit/not played - nothing can reverse that outcome.

Rational Thinking commented on September 9, 2010 at 3:31 a.m.: report abuse

I'd bet at least four figures that come morning, the Dwyer AD has a little talk with Jack Daniels and says thanks for the support, but we're not forfeiting. What happened to the team is absurdly unfair and there's no reason for the FHSAA to hand down a suspension like this. Dwyer reportedly handled it internally and if there's any penalty from the FHSAA, it should fall on Daniels, not O'Leary.
But there's also no reason to penalize the rest of the team by not playing two games. What's that going to help? Certainly it won't help impress any college scouts for kids like Maggitt and Brissett. It's certainly not going to help Dwyer in a chase for a repeat title.
Like Rick L said, the time to fight this is later, and at an administrative level.
Hopefully the FHSAA will realize what a storm they've created with this and come to their senses.
The problem is the FHSAA is like almost every other state HS association in the country, run by largely arrogant blowhards who feel the need to put their stamp on anything in the public eye.

It appeared to me that Nick O was responding to the poor sportsmanship shown by
Glenville when they realized that the refs gave them the game. They were taunting the Dwyer players and coaches because they know they got away with one. I'm sure he wasn't thinking about being on National TV at that point. The FHSAA should send a letter to Nick O and rebuke him, but a suspension is B.S.

Bo Mullen commented on September 9, 2010 at 6:01 a.m.: report abuse

While the gesture was certainly out of line and punishment to Nick O'Leary should be taken, to have the kid sit out 2 games is ridiculous. There was taunting going on from both sides from the start of this game, should #1 from Glenville be suspended for a the gator chomp move he made after a good tackle. Maybe the kids will be miked for every play to make sure there isn't any trash talking going on, during this game there was more unsportsmanlike action going on than Nick's victory salute after being robbed three times. Dwyer got hosed and thats all there is to it, as a former High School official in New England, I got sick watching this team of officials, they were very inconsistent on both sides. I commend coach Jack Daniels and I am sure the entire Dwyer team for taking this stand. These are High School kids, yes they too make mistakes, and the FHSAA like the NCAA makes decisions without thought or care.

No doubt the refes blow two calls which cost Dwyer the game. Hopefully the refes will be investigated and they will start using neutral refes for these out of state match-ups. Regardless of the refs, opponents, Ohio fans etc... O'Leary should have controlled his emotions, much like the other coaches and players from Dwyer, and walked off the field with his head held high. The kid is a great tight end, kind of put you in the mind of Jeremy Shockey. Shockey also reacts with emotions, which has been labeled a cry baby since his days at UM. I hope O'Leary can put this incident behind him and restore his image. The best way of during that is to continue to support his team, and encourage his coaches and teammates to play like champions in his absence.

I really hope this article is inaccurate, because think about the message Dwyer High School will be sending, not only to their players, fans, and supporters, but to the entire NATION. Every sports fan across the nation witnessed waht happened, so don't let the refes off the hook by not playing in O'Leary absence

I love sports at every level, but I am sick and tired of hearing about "heat of the moment" and "he's an emotional player" and "he's just reacting to getting screwed."
Get a grip. What happens to people in the work place if "in the heat of the moment" you get angry and give your boss the finger. See ya ! or if this player is "in the heat of the moment" with your teenage daughter who is trying to tell him no. or "in the heat of the moment" while he is kicking the crap out of some kid because he didn't get his way. There are consequences for every action. he is not a child he is 118 and old enough to serve in the military.
Yes they got screwed. Yes I would be angry off too. But why is the coach penalizing his team for the actions of one player. What about his senior players who lose 2 games in their final season of eligibility. or the rest of the team who won't make the playoofs because of the 2 losses.
and where is the school administration? Does the football program run the school?
What is the lesson being taught? Make your on rules. When things don't go your way, pout. Show your butt when you are unhappy.
The FHAA is very consistant on this policy. When my son gave an opposing player the finger in a soccer game in 2001 he was given a 4 game suspension by the FHAA. We didn.t like it, but it was what it was. These are games people. Games.

However, Mr. O'leary was a representative of his school and unfortunately made an obscene gesture that was caught on tv. If you make mistakes like this you need to face consequences. You can't put 1 player ahead of the team, if he screwed up he needs to pay, not the rest of the team. What happened to high school athletics being used to mold our young people, teach them right from wrong and make them accountable for their actions. Hey, this is all part of growing up. Anyone watching clips of the game knows that it was literally taken away by the Ohio refs and given to the Ohio high school team. Even Kirk Herbstreit--who put the game together--admits as much.

But that still doesn't excuse Nick O'Leary's actions. O'Leary's actions were understandable given the situation, but they weren't justifiable.

As for the decision to forfeit the games, that's the team's decision. I do feel bad that some very bad calls by Ohio refs in the ESPN game have caused so many problems in Dwyer's football program. This isn't what high school football is supposed to be about.

How many times have you seen Tiger do the same live on TV and they dont even catch it, but replay it over and over on Sportscenter. This is part of competitive sports it has happened before and will happen every game no matter. The finger was probably the cleanest thing said during the heat of the moment. The TEAM played their tails off to be let down by a few bad calls. Dont let this spoil your season because a few people in the athletic assoc believe they are doing something right. So the ref's made a bad call. Games will come and go, bad calls will be made everyday. The thing we will remember over the years about this game now will be little Nicki's temper tantrum. Nick you have alot of growing up to do.

This story reminds me of the baseball game in early June where the ref made a bad call and ended the chance for the pitcher to have a perfect game. This is a story that was widely covered by the news media, mainly for the reaction from the player. He didn't give the finger like some mad, entitled high school kid, or cuss out the ref or other players like some overpaid pro athlete. He handled the mistake of another with dignity and grace. He was shocked, but then accepted something that couldn't be changed. One would hope that younger athletes from all sports would have learned a lesson from this guy. It's called sportsmanship. And for all those athletes and coaches who have forgotten what that means, here's the definition. SPORTSMANSHIP :expresses an aspiration or ethos that the activity will be enjoyed for its own sake, with proper consideration for fairness, ethics, respect, and a sense of fellowship with one's competitors. Being a "good sport" involves being a "good winner" as well as being a "good loser". Be a good loser, guys. Accept the consequences for your actions, or the actions of other team members. There's more than one guy on a football team and forfeiting games because of one person sure doesn't seem like good sportsmanship to me.

What happened to sportsmanship? Shouldn't this coach be teaching these young man how to act proudly and honorably? Really, this is HIGH SCHOOL. Although the circumstances were emotionally charged, it's about time these young men started to conduct themselves with dignity. I am very disappointed that this coach is not teaching the rest of the team that emotionally charged outbursts have consequences and if you choose to act in a certain way, the outcome is not positive. I would not let my son play for this coach and I'm shocked by all of the people that think it's okay for a high school football player to act out in such an unsportsmanlike manner.

Its easy for people to sit in judgment when bad things dont happen to them, but to others. O'Leary is still in high school after all and we are telling him to act like a man? He is still a kid, and he should not get criticised because in the heat of the moment after his team had the game stolen from them and his team was being taunted by some thugs from Glenville he flips them the bird. Its not like he went off and hit someone. That would have been unacceptable. I support the coaches decision to forfeit the games, it shows team unity. I'm not sure how the law reads but the game was played in Ohio outside of the jurisdiction of Florida regulatory bodies therefore, the FHSAA should have no say in the matter. O'Leary just so happened to flick someone off on the othere side of the field and it was caught on camera, which pales in comparison to some of the stuff those boys are saying to each other on the field.

Abacoa commented on September 9, 2010 at 8:17 a.m.: report abuse

My kudos to Coach Daniels for standing by his player. I can't see a coach suspending a player for reacting to such an injustice and it is a matter to be handled internally. The gesture only became a big deal because the camera was on O' Leary because he is a top player and he has a big name. I am sure he wasn't the only person there to give a half peace sign that day, he just got caught on camera. It has already been decided that the game officials won't be disciplined. The FHSAA is punishing the victim.

How about Dwyer's next 2 opponents? They should lobby the FHSAA to overturn the suspension so their programs won't lose the opportunity to play the next 2 weeks. Right now is the time for area coaches to work together to protect the integrity of the game. The FHSAA obviously is not doing this.

Hey I'm goin to put it like this, I feel the same way nick did and that game I'm football player for one of the Florida high schools. Me and my teammates seen that game, hell all school and the state of Florida seen that game, and seen that Dwyer won that game hands down. And no matter how many times they got that touchdown they won that game, ref seen it too. And for billy bob, what we go through as football player is not e z it's hard work and to play on ESPN is a big thing for us, as well play a team from a difference state is a big thing too. But when you lose a game like that and that way, yeah you going to get mad. You going to do thing that you don't mean to do but it happen. And when you know won that game and that team know they loss, they going to start talking mad B.S to you Your reactoin is going to be like nick. We all know he didn't mean to do that but it happen I know he wish he could of did something that not going to put him on the spot like that. Everyone's emotions were running high and the Glenville players were taunting our boys. Nick shouldn't have done what he did but in the heat of the moment any one of us might have done the same thing. He doesn't deserve a two game suspension for this!!! Shame on you FHSAA!

I think what the FHSAA did was the right thing. When refs hear kids swear at an interception or teams disagreeing with each other they are suspended for a game or two. I mean what O'leary did was wrong, yes he admits it but there are consequences on your actions. Buck up Panthers One person doesnt make the team why should the other players have to suffer because of one person. This opportunity could give someone else the time to shine. Dwyer coaches you are wrong for making that decision. WRONG!!

Coach Daniels, maybe you should do some coaching instead of your usual chest pumping antics. Take it like a man, your player reacted to a terrible call, the team was penalized unjustly, but his reaction was uncalled for. Teach these young men to rise above bad situations, and move on.
The entire Dwyer team feels this entitlement as well, and it is wrong.Own up to your mistakes, Have seen this for many years with this coaching staff, and now since a celeb is in the mist, it has gotten much worse.

I agree with and Support Dwyer Coach Jack Daniels 100%. It takes guts to stick behind your players and stand up to the idiots at FHSAA. I do not condone O'Leary's actions but given the circumstances 90% of all competitive young immature athletes would have reacted in a similar manner after busting their butts all summer and playing 140 plays only to get cheated by a bunch of HOMERS that can't stand the fact that Ohio teams can't compete with Florida teams at any level. Kirk Herbstreit, Drew Russell from Intersports and FHSAA should be supporting Dwyer in this matter and calling for an investigation for the blatent cheating that occured Monday instead of penalizing Dwyer. What the refs did Monday was bad, what the FHSAA did Wednesday is worse.

It amazes me that so many expect so little from a "kid" playing a game while others his age are expected to fight in wars and otherwise not act like children. While an incredibly unfair situation his teammates were able to handle it without acting in such a classless manner. He did what he did and the excuses are pathetic. It isn't acceptable under the rules of sportsmanship. Nowhere does it say "we expect the athletes to exhibit proper behavior except in emotionally charged situations." If you can't handle these types of situations then maybe you need to mature before you step on the field again. It is in these type of situations that our true character shows. It is easy to be a good sport when things go right.

All of you people attacking this 17 or 18 year old kid from the safety of your key boards don`t now or never did have the strength of character or athletic ability Nick O'Leary has. He, like the entire Dwyer team traveled to Ohio, played their hearts out, were cheated and then taunted. What he did was wrong but understandable and not criminal. In my opinion they are lucky they didn`t get 45 birds. I saw the "little spoiled rich kid" put his shoulder down and drive 3 underprivileged kids 5 yards for a first down in the first quarter, make a one on one tackle on defence "strength of character" catch the ball in crucial situations and make something happen "athletic ability" raise his arms in celebration when a teammate scored the first of 3 game winning touchdowns that were not touchdowns? Then respond to taunting with a gesture that was unfortunate but at 18 or 48 understandable. I would say the same thing if it was Dwyers nose tackle, and he aint rich, but in about 6 or 7 years he will be.

amy commented on September 9, 2010 at 8:38 a.m.: report abuse

Interesting that they will continually show the replay of the obscene gesture yet the replay showing the obvious touchdown and uneducated call are not allowed to be relied on. I support Dwyer. They ARE the real winners. Anyone that watched the game saw the play and heard the announcers disagree with the reffs. It doesn't matter who the parents are, how much money the family has, or what the last name is. If this had happened to a poor homeless kid living in a box and HE has flipped off a reff most of the negative comments would never be made. People have to stop projecting their dissatisfaction with there own financial situation on those who come from a family with more. Bottom line, these are kids, they were screwed with a lack of lubricant and now they get drug through the mud yet again by people who have no clue.

The coach isnt responsible for O'learys actions and had no way to prevent what Nick did. After multiple horrible calls that cost his players the game, Jack wasnt going to make it worse and give Nick a suspension on top of what happened. FHSAA did enough punishment. If Dwyer had won that game on paper I would imagine Nick would have been suspended the next game. Dwyer / Jack knows Nick was wrong for what he did. Sometimes though when a large political party like FHSAA is taking advantage of their power the smaller guys need to make a bold move to challenge them. What Dwyer is doing to stand up to the FHSAA is brave and courageous. If you feel differently move to France. The players are in full support of this move.

Had this happened on the way to the team bus I would agree with the suspension, but in the heat of the moment immediately after the refs had just 'given' the game to their hometown boys, and taunting from the other team, I believe a reprimand is the correct action. It must be tough to be a Glenville player or coach right now knowing that you only won because of biased refs. The truth is Dwyer won and everyone knows it. Was the any recourse for the Glenville team for unsporting taunting? NAW - DIDN'T THINK SO..I agree with the coach for forfeiting games rather than play without the unfairly suspended player. It shows team unity and makes a statement against the spineless FHSAA. How embarrassing for them that the regions best team is not playing games, the whole season is now tainted because of the actions of the FHSAA...

What a travesty done by adults (Ohio referees and now FHSAA) to hardworking players and coaches to ruin their season. As a parent of Division 1 athletes, I have seen it all over the years, and only a week ago the Dwyer team was all excited and hopeful of a showcase came. Emotions run high with athletes, parents, and coaches and when blatent cheating which can occur at all levels and types of sports happens, the dedicated athlete is no doubt upset beyond words. I don't condone the player's reaction, however, I do understand it. Jack Daniels has been an exemplary coach for over a decade, always taking care of his kids. His discipline of the situation should have been the end. The FHSAA should never have entered into it unless to speak to the OSAA to rectify what was clearly seen on ESPN. They obviously allowed WTD to travel to Ohio to represent the state on national tv. Who is hurt in the end.....KIDS! It was that heat of the moment repsonse we ALL have had. Rex Ryan did it at a Florida Panther hockey game. And what Pro team did you play for. There are some serious emotional players in the game of football so I am sure you would understand. He wants to be known for his abilities, and he does have awesome abilities. He made a mistake, he knows it, so let's move on. As for him being spoiled, that is not the case at all. He has a heart of gold and when he plays the game he gives it his ALL. He was simply frustrated. Can any of you say you've never been frustrated, done something something you regretted, and then wished you could take it back? It happens to us all. As a mother of a senior player on Dwyer's team , I would like to offer my commentary :
I have known Nick O'Leary since he and my son played the perfect season at Benjamin in eighth grade. He also was on the winning State Championship Lacrosse team at Dwyer . He is multi-talented.
He has not been a "spoiled" kid. He has wonderful parents who have taught him good sportsmanship & manners. He has always been polite in my presence. His grandparents sit in the stands and acts as proud as all of the other grandparents and parents.
Anyone of you who feel that you have a "right" to comment on his family are totally out of line. What gives you the right? You don't.
As we all saw... Nick Played his heart out at the game, not only as tight end, tailback, punt returner, and more.
I do not condone his actions after the game, while I certainly do understand them.
Haven't anyone of YOU ever done anything in a reactive manner to some "injustice" albeit real or imagined that you felt was perpetrated on you? As we saw , this was not "imagined". Neither the FHSAA or Coach Daniels should make "knee-jerk" responses to what transpired. Hopefully, cool & mature heads will prevail and Nick should receive a rebuke or at max a one game suspension, while Coach Daniels should allow the games against Palm Beach Gardens& Pahokee to go on as scheduled. By doing so, he will responsibly portray the fine coach that he is & is there to lead ALL of the players and to show that he cares for them as well, which he does.
I, as a parent will urge you to write a letter of protest to the FHSAA for their actions as well as a note to Coach Daniels as he is a reasonable man with a great deal of integrity. ( Remember when J. Johnson quit the Dolphins in frustration after his mother died? He & Huisenga met and he was back a few days later.) This CAN BE resolved to everyone's satisfaction. What it will teach my son and the other players is that conflict resolution is the answer to many things.
Thank you.

I disagree with many posts here. I don't believe ANY high school football game is "just a game." These players ESPECIALLY IN THE FLORIDA HEAT, "study" harder for EACH season and EACH game than for any single class. (perhaps harder than for all their classes combined). Each and every one of them practices (and plays) through sore muscles, stomach pains, equipment failure, and dehydration due to the stifling heat of Florida summers, autumns and, often, even winters. I've witnessed Florida's high school football players adored when they're winning and taunted unmercifully when they make a mistake or are losing; OFTEN by parents in the stands as well as fellow students and sometimes pundits. What are you people THINKING????? Football is (in my humble opionion) made too much of at many schools (both high school and college) but it is NEVER "just a game". EVERY game, every practice and every season is a lesson in living. It is FAR more than any class could teach on the importance of the balance between cooperation and competition in nearly EVERY job one of them might have in the future. Each game (won or lost) is a lesson hard learned; one that can serve well in every young man's future be he the head of a major corporation or a ditch digger. How would it be for ANY ONE OF YOU (who say, "it's just a game") if you'd handed in a test in which you could easily prove you had answered every question correctly but you'd been handed a failing grade and THEN, handed a pentalty for exuberantly contesting the easily proven mistake in your grade? As someone here said, it was covered by TV. Such an egregious decision could easily have been watched over and over again and through instant replay the first decision could have been rescinded. But no. Instead, these "students" were forced to accept a permanent grade (on their "permanent record") which was unfair to an entire class - not just one student. And, let me repeat: being a player on a high school football team is a committment FAR bigger than any single class (or perhaps combination of several classes). It teaches FAR more than a single lesson. And to have a HUGE "grade" stolen from an entire class is not only unjust, it SHOULD be illegal. So, PLEASE - don't be so foolish as to suggest "it's only a game".

@ BRETT....you need to come down off your high horse and have a clue about the real situation. Let me start by saying I have 2 children in the Armed Services and I can guarantee that they have both flipped that finger at more than one individual...so fighting wars and the action of Nick have nothing in common. Second, how do you know that the rest of the teammates weren't responding to the taunting, derogatory, unsportsmanlike, and showboating actions of the Glenville team? YOU DON'T KNOW JACK! (as in s**t or Daniels!) ... because the camera is too focused on Nick because of his grandfather! Had the media not thought that each moment had to be a reminder of his birth, you wouldn't have seen the gesture.
Third, the punishment should fit the crime...he's being assessed punishment as though this was a level 1 offense - physical altercation! So tell me how that is fair? Other than the FHSAA trying to make a point that we take the higher moral ground...I am NOT saying that he was right, but saying that at that moment, it was understandable. Leave the punishment to the school / coach to handle.

Next time, don't blow a 16-point second-half lead and you won't have to worry about being gypped by the referees at the end.
The fact that the FHSAA had to step in to suspend O'Leary instead of Coach Daniels or the principal of the school administering the punishment themselves shows that Palm Beach Dwyer is only concerned with athletic glory and not academics. They should be ashamed of themselves and tender their immediate resignations.
O'Leary should have been dismissed from the team, suspended from school, and perhaps even expelled.
This is the University of Miami mentality at its finest. You cannot spell "scum" without "UM". I'm sure Nick O'Leary will fit in just fine with the rest of the lawless thugs in Coral Gables.

O.k I have watch the replay of the calls in doubt, yes the fade pass in the endzone was a touchdown when you slow it up via replay, but remember in game speed it dosen't look like a touchdown from the refs angle and from the angle I witness as I watch. Now the touchdown from the goaline was clearly not a touchdown his forward progress was stop plain and simple and if the time clock would have started that would have been the last play of the game. Finally the last play of the game imho was a makeup call from the previous play because that QB broke the plain of the endzone, but the question that is now being rised is he lost the ball, which is questionable at best. We all must remember there's no replay in High School football. Now should the kid be suspended, I feel yes regardless of the outcome you show sportsmanship and we must admit both teams were talking smack back and forth, it just intensified due to the outcome of the game, but the kid should know right from wrong and his actions showed clearly. I would say 2 games is over doing it but 1 would be fine.

the fhsaa has had their head up their ass for years.may of their dicisions have been intrusive, selfserving and to make them selve look important.when fhsaa first came into existance their only power was ruling on a players eligablity and its outcome. To get involved in this situation with this kind of decision only warrents a petition to disbanned fhsaa and idiotic board .what O'leary did was wrong and he knows that, but no one feels worse about the outcome than he does .To publicly embarrass him in this way is idiotic and selfserving by the fhsaa. If anyone would like to start a patition to disbann fhsaa and send it to the gov.,I would love help.what the fhsaa did was a slap in the face of anyone who has ever played high school sports.I think all the high schools and their players should petition this assanign decision.I guess none of them watched the game ,but noly the part with O'leary.that decision has affected so many lives.

For those of you who can sit behind your computer and criticize and attack an 18 year old kid and base your opinion of him AND his family by ONE in the heat of the moment action, SHAME ON YOU!
It is easy to find fault with actions of other people when you are sitting on the outside with zero connection. I can sit here all day and defend Coach Daniels and his coaches, Nick O’Leary, the entire Panther Football team and our Dwyer family until I am blue in the face but those that need to listen won’t, Stupid is as Stupid does. Simple cause and effect: Cleveland cheats (not surprissing) not once or twice, and players react. Don't punish the cheaters just punish those who object to the cheaters. Makes sense a lot of sense.

I've known Nick before he could walk. He is a good kid, and he knows he was wrong. They're not going to forfeit both because then they cannot be in the playoffs. Everyone relax. Nick is fine, he is still going to the NFL... Dwyer is fine, etc. They're going to repeat state, so all other public schools pipe down.

Pahokee Footbal Mom commented on September 9, 2010 at 9:56 a.m.: report abuse

Personally I don't know Nick but I'm sure he's a wonderful, talented player however, he made a bad decision while upset and none of us are virgins to that. Since he made the gesture on TV, I think they should have made him apologize on TV but still allowed him to play. I think this is double punishment. Yes he need to be responsible for his actions because you don't want the other players to think this type of behavior is ok. As for forfeiting the two games he can't play, I don't think it's fair to the team. Scouts are watching more players than just Nick and personally I don't want to miss a game and you guys play us for one of his suspensions. I heard about what happened in Ohio, but I agree with something I heard earlier, Dwyer, you know you won heck the world know you won so let's get past this and move on to a bigger and better season with better decisions. FHSAA probably felt like you didn't really punish him and from the decision you made to forfeit games because of one player (Nick) probably mkase them further feel that he didn't get punished because he's the star of the team.IJS

Sounds like FHSAA is doing the best immulation of the good ole' NCAA. I have no connection to any of this other than having played both HS and College athletics and I will say that if I got blatantly screwed (which I have) then I would have been well beyond making "an obscene gesture". Matter of fact, I ran my A$$ off everyday for a month (weekends included) for an incident of the same manner. I'd do it again too! It's called pride. When you pour so much into something only for it to be stolen from you by weak spineless trash you react...it happens. If you're wondering, there are 2 officials that are no longer allowed to participate in any capacity in HS sports in this state b/c of the afforementioned incident. How are these Ohio officials being dealt with? Nothing? THAT is a tragedy to sports.

Tough lesson to learn. Youth expect paid, qualified, authority figures to do the right thing. Everyone exspects this but as adults we have experienced (not to this extent ) bad calls. The refs in this game should definitely be held accountable for a job poorly done and at the very least, sumbit a written apology to the team. This should not be regarded as another "Oh well" moment by them as well as the FHSAA.
In edition to the FHSAA being the watch dog of player decorum, as an organization acting in the best interest of all Florida high school sports programs they should show support for a Florida team whenever a blantant injustice occurs that determines the outcome of a game.
If they choose to ignore what happened to Dwyer during that game, it is another major insult to this team , fans and all high school sports programs.
Wake up FHSAA , react and show support for Florida teams that are cheated .

The FHSAA went a little "overboard" in their decision to make O'Leary's punishment a 2-game suspension. However, had Dwyer disciplined him by rendering a 1-game suspension, it would not only have been appropriate and just, but it most likely would've satisfied the FHSAA. Regardless of the outcome of the game, in which I believe Dwyer was absolutely "robbed", no one should disgrace themselves, their teammates, their family and friends by behaving in a manner that is unsportsmanlike in ANY way. Save the "heat of the moment" pleas for those who have time to absorb such nonsense.

By deciding to have the entire team sit-out the next two games due to O'Leary being suspended for the same number of games is sending the wrong message to him (O'Leary) and the other students. NO ONE player is BIGGER than the team or the game itself. Would an NCAA or NFL team act in the same manner? Not hardly. Jack Daniels is a better man and a better coach than this.

What will sitting out two games for the entire team teach these fine young men about life? Loyalty is admirable, and a valuable asset. But so is humility, responsibility and accountability. When O'Leary gets fired for acting inappropriately while working as an adult in the real world, do you believe his co-workers will quit in support of him in order to defy their employer? Not likely.

I implore him (Daniels), the athletic director, and the parents to reconsider a decision that will haunt this team for the rest of their lives.

If Dwyer is indeed the team they believe themselves to be, and if the principal and the athletic director are the leaders they're supposed to be, they should act in a mature manner and hit the field with the same spirit and fury they're attempting to display with this 2-game "sit-out"!

There is no empathy here.

UNBELIEVABLE

1. A Florida team goes up to Ohio to play the #1 team in the state and #4 in the nation and one of the largest size wise.
2. They both play a hard and exciting high school game on national TV.
3. There is taunting on the field (probably more from the home team--that's football).
4. The Florida team has a great come back in the final 4 minutes.
5. The Florida team has 3 touchdowns in the final 2 minutes not called.
6. There are no fights throughout the whole game.
7. A 18-year-old-kid who plays one of the great high school game on both offence and defence and has just lost a game of his life, flips the taunting team the bird as they go off the field (that's football).
8. The FHSAA from his home state of Florida suspends him for 2 games (that not football).
9. The school, the coach, and players stand by thier team and player (that's football).

What's Really Not Believable is the refs calls and the actions of Florida's FHSAA (thanks for standing up for your Florida teams when they play out of state, that's not football).

Nick was wrong, but he was caught up in the emotion and responding to the taunts and harrassment from the Glenville players.

Coach Daniels, please reconsider the forfeitures. Up until now, you've conducted yourself like a true gentleman, leader and role model. Don't punish the entire team, the entire school. You've made your point, now reconsider and let the team play. For many of the players, this is the last season of football they will ever play. Don't cut it short by two games. Also, never mind that the games may not count towards a championship, the team needs to play these games to be better prepared for the following games by playing. You don't want to go into game 4 with the last game played being the Ohio spectacle 4 weeks prior.

What you should be doing is reviewing the tape, confirming the TD and awarding the victory to Dwyer or at least not recognizing the loss. The FHSAA need to grow a pair and stand up for their school.

Quite simply, the FHSAA is completely wrong here.

Was the kid wrong for flipping off the refs? Yes. But damn, did they deserve it. I'm an Ohio State graduate and was rooting for Glenville (we get kids from there all the time) and I'm absolutely disgusted by the officiating in this game.

Not one TD off the board. Not two TDs off the board. THREE TDS off the board in the last minute of the game.

If I were O'Leary, I wouldn't have flipped the refs off. I'd have probably choked one of them on the field Darth Vader style.

Let the kid play. This is a ridiculous situation made worse if he is suspended.

This is a load of crap. The fact is that the players from both teams were doing MANY unsportsmanlike like things in the minutes after the game. Just because this kid was caught on camera doesn't warrant him being punished. If cameras are allowed to be a factor in this decision, then the cameras should be allowed to determine the real outcome of the game - which anyone knows that saw it would have determined a different winner.

Larry from Ohio commented on September 9, 2010 at 10:25 a.m.: report abuse

The officiating was bad, and it almost certainly cost the Florida team the game. That cannot serve as an excuse for the players misdeed and playing an ineligilble player.
A high school coach who knowingly plays a ineligible player should be fired.

Big E commented on September 9, 2010 at 10:28 a.m.: report abuse

Too bad for Nick who I thought was the best player in the game for both team. I am from Cleveland living in Columbus and was pulling for Glenville. At the end of the game there was no excuse for the actions of both the Ohio officials to screw up the calls which were clearly touchdowns and Nick O'Leary.

If bad call, the other team, or game can get to him now at 17 or 18 what do you think is going to happen to him in college and maybe the pros. You have to control your emotions at least starting now.

Good Luck to Dwyer for the rest of the season but do play your next games. As for the FHSAA they are no different than the OSHAA who always overacts all the time

Goodbye Larry from Ohio commented on September 9, 2010 at 10:32 a.m.: report abuse

Go back to Ohio. We don't need your advice on our coaches. Obviously that is really needed back in your home state. Coach Ginn allowed his players to taunt and heckle the Dwyer players after the final whistle ended the game. They acted like the thugs that they are, shameless while celebrating a win that they did not deserve instead of, realizing that the game was stolen from Dwyer, being good sports and walking over to shake their hands. Ginn is no better than the refs who handed Ginn's team that win. How sad for your state to have a stadium full of such losers. I included in that melting pot the p.o.s. parent in the stands who called a 15 year old Dwyer girl a B****. Very, very classy, huh? No Larry, we don't need your help here. Nick O'leary should not be suspended. I watched that game and the officials were totally wrong! First of all, the young man who caught the ball on the sideline of the endzone was robbed of his glorious moment. Secondly the QB Sneak was successful and the TD wasn't allowed. On top of all that the clock operator was horrible at the end of the game. Nick's frustration was totally justified. We're lucky that an obscene gesture is all that happened. My prayers are with the Panthers and coaches today! Coach Daniels believes in conseqenses and handled the situation in house which is good enough for me.

I was there and saw how the other team taunted Dwyer after the game and I commend the coaching staff for getting the players off to the locker room. FHSAA should thank the Dwyer coaching staff for the way it handled itself and the team under some of the worst calls any team has seen. Yes there was a gesture and yes the team handled it. My guess is that many teams would of fought after the game, but not this team from Palm Beach County. The coaches took control and did not let get out of control

What FHSAA should do is come in and speak to the team of how well it represented itself in it's travel and nights in the hotel and getting back safe and sound while playing a great game on the National stage. Instead they use this as a platform to disrespect a coach and team that represented the state well.

I helped get Dwyer to this game by working on it a few years ago and now I have some regrets. My goal was to showcase on of our schools who has played very well the last few years and deserved the right to play on ESPN. Right now the way FHSAA is reacting I'm not sure my time was well spent.

"dwyer side" . . . as you requested, I made a phone call to the FHSAA. Their office simply acted upon what is written in their rules. Rules of which I might add are published and should be known to all high school coaches in the state of Florida. In fact, as stated previously by another person who posted on another article concerning this matter, the FHSAA rules call for a suspension up to 1-year for "unsportsmanlike" behavior.

They also rendered this decision after Dwyer failed to render one of their own. And please spare me the "extra" running and drills at practice routine as a punishment for those that believe that would be considered such.

In other words, they (the FHSAA) didn't make up the rule, it was established at a previous date in the books.

Now, I must admit, 2-games is excessive, and 1-year would be absurd. But, they are the governing body for any high school athlete participating on any roster in the state of Florida - regardless of where the contest or event is held.

That said, according to the person I spoke to just 10-12 minutes ago, there is a possibility that Dwyer could get the suspension for O'Leary decreased by one-game provided they file an appeal. After all, it is his first offense and his past record of behavior is as stellar as his talent on the field.

We ALL know that the field officials in Ohio failed to make the right call(s) near the end of the game this past Monday. I do not believe this is an argument there. And although most of us would agree that the FHSAA issued a very harsh penalty for Nick's actions, they acted based on what

He's a passionate kid who made a kid mistake. Whether the suspension is appealed or not, he should serve his punishment accordingly and learn from the experience. He'll be a better man for it, and so will his teammates.

I sent the following to Dr. Peggy Jones, Asst. Executive Director of Athletic Services. According to the FHSAA website, she is responsible for supervising unsportsmanlike conduct of atheletes and coaches. her email is pjones@fhsaa.org. Her phone number is 352-372-9551 x 180. I say we all blow up her email and phone....

Dear Ms. Jones:

I am writing to urge you to reconsider the suspension of Nick O'Leary.

Surely, his gesture was inappropriate and he should be disciplined for his actions. In fact, internally, the coaching staff and administration had taken disciplinary action against Nick.

I just ask that you not compartmentalize your decision and consider all of the adversity he was facing in the heat of that moment:

1. He and his team had just been unjustly robbed of a victory that they fought so hard for. I'm sure you've seen the video footage.

2. He was taunted relentlessly by the Glenville players and fans immediately after the game.

3. The team as a whole, exhibited remarkable restraint under those circumstances. It really could have escalated to a riot situation.

You just had to be there to see it. I ask that you at least do a comprehensive examination of this entire situation so that you can gain a complete understanding of all the factors involved. At the conclusion of your investigation, you could then exact whatever remedies that you deem appropriate. This decision seems premature and done without benefit of all of the fact surrounding the event in question.

I feel that this decision was rushed and in the face of this adversity, the FHSAA should get behind and support the Dywer team and coaches. I also question, whether or not, the FHSAA has jurisdiction as this was not a FHSAA sponsored event....

Please reconsider, please....please... please...

What happened at the end of the game was wrong. What has happened since the end of the game is wrong.

Why would the FHSAA compound what has taken place by leveling a suspension, penalizing a team and school, simply because the incident was caught on film. And while the ability of instant replay can be used to punish, it can't be used to change the outcome of the game, ironic isn't it?

Having been an official and player, I assure you, far more inflammatory things are said and done on the field than what he did. For so many people to pass judgement here, questioning the integrity of the coach, AD, and players is beyond me.

For the people that are saying O'Leary is getting a break becuase of his family, it's more quite the opposite. Had this been any other kid at any other game, the FHSAA would have never heard of the incident nor gotten involved.

Nobody dirtier or more crooked than Ohio sports referees. They're still p*ssed at the whipping the Gators put on the Buckeyes in 2006. As for the FHSAA, what a joke they are. Not one suspension on the other team for unsportsmanlike conduct? But because a kid threw up a 'bird'?

I guess what the FHSAA wants us all to do is, give us your money, watch our programming, and work hard throughout the year to enrich us, but shut the hell up and take what we give you--and like it.

Some one needs to find the names of those referees. Feels like FIFA all over again. Referee's not being held accountable for their poor, incomprehensible performance. Why aren't they coming out public to defend themselves? Why not? Because everyone knows they are wrong, even coach Ted Ginn, Sr. Isn't he the father of the guy who's own teammates injured him in an unsportsmanlike celebration in the end-zone after returning the kick-off for a TD against The Florida Gators? In there 42-14 loss, that is? Same guy, right?

Hey Mr Ginn? Take your over-rated once again son, Buckeyes, and your stolen win, and...
Always remember--nothing will wash out that taste in your mouth you and your son still have from the old-school beatdown the Gators put on you and your son. You and your team should be proud.

O'Leary, come join the Gators or UM (ugh, that hurt) and take it out on them in college. Either way, you can count on the Buckeyes being over-rated and some Florida school whooping their tail. Sweet revenge is when you are holding the NC trophy and you say that you want to thank the most crooked HS officiating crew in Ohio for the motivation, and the FHSAA for the extra time to plan for the speech--then throw them the double-fisted BIRD with vigor. Touche.

I love people who post on these threads and hide behind an alias. Real tough. Bottom line is no one saw what the other team was doing when nick saluted them. He was being taunted by a team that unfairly won, emotions were high, did you see them? no, because the camera was on the guy who played the whole game, both sides of the ball. He was right to be angry, was it the best move, no, but no one knows what the other side was doing. I would have done the same thing and most everyone else would too. The refs are lucky they got out of there in my opinion, ohio should come out with a statement acknowledging their mistake and apologize. As far as forfeiting the games because FHSAA decided to suspend Nick, if thats what the team wants to do then they should. FHSAA should stay out of it, they say they can't do anything about the outcome of the game, then they should not do anything regarding any portion of the game. They didn't sanction it and have no authority over it. Different story if it was a FHSAA sanctioned and controlled game. Jack Daniels is a good guy. period. No ones crying about what happened, the truth is Dwyer was cheated 3 times, Nick was singled out. Nothing is being done to the ADULTS who made the mistake and nothing is being done to the other team who taunted and provoked nick. Florida has nothing to be ashamed about nor does Jack or anyone else involved with Dwyer, Ohio High school sports, the Refs and Glenville do.

A hard fought game ends with terrible officiating creating an emotionaly charged situation. The TV producer tells the camera to focus on the star of the losing team as he was easily the most influential player on the field to capture the "agony of defeat." But he is no longer a football player, the game is over, he is just a hurt kid.

An inner-city public school from Cleveland plays a school from Palm Beach County, FL. Regardless of the outcome, do you really think there was not going to be trash talking?

Given the Florida - Ohio interactions the last 10 years from presidential elections to football games let's not judge an entire area based on a terrible officiating crew.

What the FHSAA should be doing is celebrating a tremendous game. If the score counted or it they had not even come close, that was easily the best game of the Herbstreit Classic. The FHSAA could have helped soothe the wound by congratulating Dwyer for their tremendous showing, never say die attitude, etc. Based on their reaction, I would think that any FL school would have to think twice about letting their team participate in any televised games in the future lest they suffer the same fate for a player momentarily losing his head.

The camera was focused on O'Leary because he played hard and was robbed. If he was not talented, it wouldn't matter if he was Ted Ginn's kid..

All this is reverse discrimination - he's an 18 year old senior who happens to be the grandson of somebody famous. If the camera had caught anyone else on the team, there would have been none of this type of hysteria.

hhhh commented on September 9, 2010 at 11:18 a.m.: report abuse

I'm just so upset that FSHAA is instead looking at the whole picture and suspending O'Leary. I agree with Coach Daniels- "There are no repercussions for the adults who made the calls on the field, but there is for an 18-year-old kid who reacted in the heat of the moment."
The only reason FSHAA is doing this because it was on national television - everyone saw and that probably hurts their image. Nick did not know that he was being filmed. Why do they not look at the kids who were making fun of our players? The coaching staff did an amzing job getting the teams into the locker rooms without any punches thrown.
It's Nick's senior year and he gets suspended for flicking someone off, after the game? Coach Daniels had a long talk with him and he regretted his actions. This is really sad for the whole school.

What is worse in terms of unsportsmanlike conduct?

A gesture towards a player(s) or a late hit, spearing, or hitting someone when already out of bounds? I saw several instances of those in that game and others yet I have heard nothing of additional involvement from the FHSAA.

Any other unsportsmanlike conduct would warrant a flag and a 15 yard penalty. Is the same level of judgement and punishment being applied here as compared to an act that could intentionally harm someone? It doesn't look like it.

"M. Okell: Florida has nothing to be ashamed about nor does Jack or anyone else involved with Dwyer, Ohio High school sports, the Refs and Glenville do. "

M. Okell - Let's not go overboard condemning all Ohio High School sports based on one game. Terrible officiating. Leave it at that. If we put a camera on every suburban vs. inner city high school game in every state in the country you would see very similar reactions. Does that make it right? No.

Let's walk the officials and FHSAA to the hangman's noose. After that, save the name calling and accusations.

Devils Den commented on September 9, 2010 at 11:24 a.m.: report abuse

Are you kidding me. Two games for shooting a bird at someone. For some reason people feel that it is ok to attack athletes and over react to any of their bad judgments. A two game suspension for a minor incident is a complete over reaction. I dont know Nick but he didn't get accused of raping anyone (Roethlisberger) or killing a dog (Michael Vick). I worked in the school system for 14 years in Palm Beach county and shooting a bird is rarely beyond a verbal reprimand. This is pure discrimination against an athlete because had this occured with a non athlete the kid may not have received anything above a verbal reprimand. I'm a Marine and a Cop and discipline does not have to occur by hitting the kid with a hammer across the head. FHSAA WHAT A JOKE.

“As an eyewitness to the event, I can tell you that [O'Leary] exhibited restraint beyond his years. What was not captured on the video was the aggressive taunting by a few of the Glenville players during the period just after the final horn. He reacted to this provocation in the heat of the moment in that manner because he knew that physically engaging those players and the student support personnel would be totally unacceptable. The notoriety of [the] gesture on television and the internet is unfortunate.

Conferencing with the student-athlete, I have discovered that he deeply regrets his course of action at that moment and understands that it is not acceptable from, indicative of, a representative of Dwyer, the Palm Beach County School District of the State of Florida.

He also understands that, at times, infringements incur penalties. Coach Jack Daniels has already handed down appropriate punitive measures toward the student-athlete and has counseled him and his teammates regarding this matter. As a group, we are attempting to put the negatives of the “Ohio Experience” behind us, as there are so many positives to recollect.”

Regardless of what happened. A two game suspension is excessive. A written or verbal warning from FHSAA would have been sufficient, however Dwyer had already issued a verbal warning to Nick. Look at the school conduct chart and see what the standard penalty is for making an innapropriate gesture.

I didn't say his actions were right, what I am saying is FHSAA has no right to discipline him because they had no control over the game, as they have stated. I apologize I left out saying the FHSAA should be ashamed of themselves because they should. Everyone in the country knows Dwyer was cheated that is why I say it is a black eye on Ohio high school sports and the ones who govern it and Glenville because they don't have the integrity to come out and say yea, bad calls were made, we hate that we won that way. There's no name calling or accusations, what I am saying is if nick had not been on T.V. this wouldn't be an issue, we didn't see what the other side was doing to provoke him, he was singled out, in a moment of anger after being cheated, FHSAA should leave him alone and the comparable side in Ohio should apologize.

I don't believe the FHSAA has jurisdiction over the game or after-game activities in Ohio. I think they are INCORRECT to intervene. However, I AM disappointed in Jack Daniels and Dr. Lee (Dwyer's principal) for not taking the initiative (prior to FHSAA intervention) and suspending or appologizing for NIck's post-game gesture. The coach and principal are sending the wrong message to kids by condoning bad behavior. Running a few wind sprints does not constitute "handling " a situation. In essence, JD and Dr. Lee are saying "go ahead and act improperly and we will support your bad behavior". I attended the game in Ohio and I was very upset by the officials failure to recognize Dwyer's obvious touchdown(s) in the final minutes of the game. However, the "heat of the moment" or "busting his butt since August" is no excuse for Nick's actions. He is a great talent and competitor on the football field but he needs to know he's not above reproach and he is responsible for his poor judgement. JD and Dr. Lee need to consider the other 50+ kids on the team (the non-Nicklaus decendents) who acted responsibly and deserve to play the next two weeks.

I encourage all to call and or write. The 2 game suspension (1/4 of the season) is obsessive and irrespnsible. They have a obligation to support FLORIDA teams (that is where the F in FHSAA comes from). The should be taking everything into consideration. They should be demanding answers to the CHEATING that occcured in Ohio instead of punishing DWYER more than they already have been.

What a Joke! commented on September 9, 2010 at 12:26 p.m.: report abuse

No excusing the gestures, but were any of you there? I have spoken to a witness that WAS there and the Glenville team was totally out of line as well. The things that were being screamed at the Dwyer team were revolting and disgusting, sounding like prison yard talk.
No one is playing footage of their side and their lack of sportsmanship( there must be somebody who filmed them).
It is puzzling to me how replay cannot be used for the obvious touchdowns scored by Dwyer, yet FHSS is claiming that because they have viewed the footage (replay)after the game, they have the right to invoke a punishment of a player's actions that they did not even view in person. They were not there! This wasn't their game or jurisdiction.
Really?? No wonder these refs have to have to be escorted off the fields after games! What a joke.
That being said....JACK..LET'S PLAY THESE 2 GAMES! POUR IT ON BOYS!

And if you have you would know damn well how we feel about the situation oh and -Richard- its NOT! just a game its everything our team loves and live for its like oh your mother died but no worries its "Just Your Mother".

Tony A commented on September 9, 2010 at 2:59 p.m.: report abuse

OK, how about this:

1) The school or parents or someone bring suit against FHSAA claiming that they did not have jurisdiction in this matter and as such the 2 game suspension of O'Leary is invalid.

2) Dwyer does not forfeit 2 upcoming games, but rather plays AND utilizes O'Leary in those games contrary to the FHSAA ruling.

If the suit is upheld, the season will have progressed normally (other than the fiasco in Ohio), if not, the same two games that would have been forfeited will be, but, after the fact, and no desperately needed revenue will be lost.

3) Concurrent with the lawsuit, establish an email campaign to get the appropriate people at FHSAA fired. That should get their attention.

JMG commented on September 9, 2010 at 3:40 p.m.: report abuse

Just pointing out that all of you who are claiming that his family relations or money have something to do with his suspension severity are ignorant. Money means sht - it's JUSTICE that should be recognized in this scenario. If you're irritated because you wouldn't be able to "buy" your kid out of this, you've just grouped every person better off than you into the category of a "spoiled brat" because they have financial stability. I guarantee you that Jack Nicklaus, himself, reprimanded his grandson in private and would rather not get involved in all of the nonsense - it's not his style to step in like many of you claim with "a phone call to the right people." I guarantee you that his mom and dad had their own form of holding Nick accountable - and he comes from GREAT parents who probably laid into him just like most good parents would. I guarantee you that Nick also got a talking to from the AD, principal, and Jack Daniels...which is something I wouldn't have wanted to be in the room for. I also guarantee you that he KNOWS what he did was wrong, but does the FHSAA have any grasp of right and wrong? I surely know the game officials do not.

Nick and Coach D are paying the price on a very public and national level for something that should be acute on the radar...flipping a bird? Come on, when I went to Dwyer kids got kicked out of school for making hit lists and bomb threats - a middle finger? Are we serious? I'd like to see anyone deal with the kind of pressure and scrutiny this team is under. Dwyer is Dwyer. Football is more than a game to some of these kids - ultimately, it can be a determinant on if they further their education due to the fact that half the team probably couldn't afford to go - athletics is their way in via scholarship. ANY PLAYER with that kind of talent out of Dwyer would be supported regardless of what his name is. It could've been Maggitt or Jacoby suspended and Dwyer STILL would've had their backs. Again, the media (ESPN) focused on Nick because of his grandfather. Everyone (including the media) needs to back off. Let Nick make his own name without Big Jack. He's very capable and with as good as he is, he could've done it without the association...and so could the team because they're THAT good. FHSAA needs to hear it and retract the suspension. Let the kids play without all of this horsesht.

Mr. Magoo commented on September 9, 2010 at 11:04 p.m.: report abuse

Nobody seems to be saying that Dwyer didn't get hosed. Ironically, Dwyer hasn't filed a protest, said they would, or asked for disciplinary action against the officials.

This was extended and kept alive by the FHSAA, not Dwyer. In a game out of state, after a kid was already suspended from school for a day, and earning a special conditioning workout for the entire team, they jumped in. It would be fading into oblivion if not for them. If they can intervene this way, why not the other way around and find out what got him so upset. If most knew what went down, their view of it might be a little different.

By the way, Dwyer's kids who played both ways showed at the end of the game they were in better shape than Glenville, who platooned. Those workouts are hard without anything extra, it wasn't pleasant and likely worse than anything anyone talking like a fool could make it through right now.

The referees left the game without it even being discussed, abandoning their job before it was over. So, if it extended beyond the game, once again you can look at the officials. Nobody no matter what you think about this, if they were in Dwyer's shoes, would have walked away pleased with the outcome.

And for all the big, puffed out chest banter amongst the ones ripping Dwyer a new one, if you read Daniel's willingness to support a player he believed was wronged, and still wouldn't want to play for him then you're a fool.

You want to buy something, but you do not want to be ripped off. Do you want to play football, but you do not want to take it out from you, like countless times. Do you know the consequences of your behavior, but not familiar with the surroundings, can prevent you bait the trap.
